PGWP Refused Because of Missing Language Test Results? What International Graduates Can Do Next

For many international students, the Post-Graduation Work Permit is a critical step after graduation. It can allow eligible graduates from Canadian schools to work in Canada, gain Canadian experience, and build a path toward permanent residence.

But some graduates are now facing an unexpected problem: their PGWP applications are being refused because language test results were missing from the application.

For graduates already working in Canada, a PGWP refusal can be extremely disruptive. It may affect your job, your status, and your future immigration plans.

Why Are PGWP Applications Being Refused for Missing Language Test Results?

IRCC now requires most PGWP applicants to provide proof of English or French language ability if they apply on or after November 1, 2024. The required language level depends on the type of program completed.

For some applicants, the issue may not be their actual language ability. The problem may be that the test result was not included in the correct place when the application was submitted. That can lead to a refusal, even if the applicant studied in Canada, speaks English or French fluently, and otherwise believed they were eligible.

What Happens If Your PGWP Is Refused?

A PGWP refusal can have immediate consequences. You may need to stop working. You may also need to review whether you still have valid temporary resident status in Canada.

Timing matters. Key dates may include:

  • the date you completed your program

  • the date your study permit expired

  • the date you submitted your PGWP application

  • the date you took your language test

  • the date IRCC refused the application

Those dates may determine whether you can reapply, request reconsideration, restore your status, or consider another legal option.

What Are Your Options After a PGWP Refusal?

The right option depends on your specific facts. A refusal because of missing language test results does not always mean there is no path forward. But the next step should be handled carefully.

Should You Request Reconsideration?

A reconsideration request asks IRCC to look at the decision again. It may be appropriate if there was an error, missing context, or a fairness concern. But reconsideration is not automatic. IRCC does not have to reopen every refused application.

A reconsideration request also may not protect your status or your ability to work. Before requesting reconsideration, review whether:

  • the language test result existed when you applied

  • it was uploaded anywhere in the application

  • the refusal letter accurately describes your documents

  • you still have valid temporary status

  • a new PGWP application is still possible

  • a Federal Court deadline may be approaching

Can You Reapply After a PGWP Refusal?

Sometimes, a new application may be possible. But not always. A new PGWP application may be difficult if your eligibility period has passed, your study permit has expired, your temporary status has lapsed, or your language test was not valid at the right time.

If you are no longer in status, you may need to review whether status restoration is available. If your long-term goal is to stay in Canada permanently, you may also need to review other pathways, including Express Entry or other permanent residence options.

When Could Federal Court Judicial Review Be Relevant?

In some cases, a PGWP refusal may need to be reviewed for possible judicial review.

Federal Court judicial review is not simply asking IRCC to change its mind. The Court reviews whether the decision was lawful, reasonable, and procedurally fair. If the Court finds a reviewable error, the matter may be sent back for redetermination.

Judicial review may be relevant if IRCC misunderstood the evidence, failed to consider important documents, or made a decision that appears unreasonable based on the facts.
